Welcome to Service Check Limited. These Terms and Conditions ("Terms") govern your access to and use of our software platform, available via web. By creating an account, subscribing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Definitions

  • “We,” “us,” “our” refer to Service Check Limited, a New Zealand-owned and operated company that provides the Service.
  • “You,” “your” refers to the individual or business entity that registers for, accesses, or uses the Service, including any authorised employees, representatives, or contractors.
  • “Service” refers to the software platform provided by Service Check Limited for vehicle service tracking, customer management, and related workshop functions.

1. Who We Are

Service Check Limited is a proudly New Zealand-owned and operated technology company dedicated to helping mechanic shops and automotive service providers modernise their operations. Our platform, Service Check is a cloud-based software solution built to simplify and streamline the day-to-day workflow in vehicle service businesses.

We understand the hands-on nature of the automotive trade — the time pressure, customer expectations, and admin overhead. That’s why we’ve designed our platform to help small to medium-sized mechanic shops handle everything from customer bookings and service tracking to job status updates all in one easy-to-use dashboard.

Built locally for local businesses, our mission is to empower workshops across New Zealand with affordable, practical technology that saves time, improves customer communication, and brings clarity to everyday operations.

2. Eligibility

  • You must be at least 18 years of age and capable of entering into a legally binding agreement.
  • You must be acting on behalf of a registered business, company, or sole trader operating in the automotive or vehicle servicing industry.
  • You must have the authority to act on behalf of your business, including accepting these Terms and entering into a commercial agreement with Service Check Limited.
  • You must agree to use the Service only for lawful purposes and in compliance with all applicable New Zealand laws and regulations.
  • The Service is intended for use in New Zealand. If you choose to access it from outside New Zealand, you are responsible for compliance with local laws.

By creating an account or using the Service, you represent and warrant that you meet all of the above requirements. If you do not meet these criteria, you must not use the Service.

3. Your Responsibilities

3.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect any unauthorised use of your account.

3.2 Accurate Information

You must provide accurate, complete, and up-to-date information when registering and using the Service. You must keep your business profile, billing details, and contact information current at all times.

3.3 Authorised Use

You agree to use the Service solely for business purposes related to vehicle servicing and workshop operations. You must not use the Service for any unlawful, fraudulent, or abusive activities. You must not use the Service to send spam, unsolicited marketing messages, or misleading communication to customers.

3.4 Compliance with Laws

You are responsible for ensuring your use of the Service complies with all applicable laws, industry regulations, and business standards in New Zealand.

3.5 Responsible Use of Features

You must not attempt to bypass usage limits, manipulate system behaviour, or access features or data that you are not authorised to access. You may not reverse engineer, decompile, or otherwise attempt to extract the underlying code, structure, or logic of the platform.

3.6 Data Responsibility

You are solely responsible for the accuracy, legality, and content of all data entered into the system, including customer information, service records, and vehicle data. You agree not to upload, input, or store any content that is unlawful, harmful, offensive, or infringing on third-party rights.

3.7 Third-Party Integrations

If you use or connect to third-party services (e.g., SMS gateways, payment processors, CarJam), you are responsible for complying with their respective terms of service and for any associated costs.

3.8 Fair Use

You agree to use the Service in a fair and reasonable manner and not in a way that negatively impacts platform performance or disrupts service for other users.

3.9 Software Updates and Downtime

You acknowledge that the Service may be temporarily unavailable due to maintenance, updates, or technical issues. While we aim to minimize disruptions, we are not liable for any resulting inconvenience or loss.

3.10 No Resale or Redistribution

You may not resell, sublicense, rent, or otherwise redistribute access to the Service or any of its features to third parties without our prior written consent.

3.11 Vehicle Lookup Usage

The Service includes vehicle information lookup features powered by third-party providers such as CarJam. This feature is provided strictly for managing genuine vehicle service jobs within the platform. Using the software primarily or solely to search for vehicle information without creating valid service records is strictly prohibited and may result in additional charges or account restrictions. We reserve the right to monitor lookup activity and take necessary action if the system is being misused or exploited for non-service-related purposes.

4. Subscription and Payment

  • Access to the Service is offered through a single subscription plan priced at $69.99 NZD per month plus GST.
  • Promotional Offer: As a special introductory offer, the subscription is available for $49.99 NZD per month plus GST for all new subscribers who sign up before 31 December 2025. This promotional rate will remain in effect until 31 December 2025, after which the subscription will automatically renew at the standard rate of $69.99 NZD per month plus GST from 1 January 2026 onwards.
  • The subscription includes unlimited job creation with no monthly limits or restrictions.
  • All payments are billed monthly in advance, and subscriptions auto-renew unless cancelled.
  • To cancel your subscription, you must contact us via email at support@servicecheck.co.nz or by phone. Your access will remain valid until the end of your current billing cycle. No refunds will be provided for partial months.
  • Service Check Limited reserves the right to increase subscription fees or modify pricing plans at its discretion. We will provide you with at least 30 days' prior notice of any price increase via email and/or phone call before the change takes effect.
  • Service Availability and Downtime: While we strive to maintain continuous access to the Service, there may be occasions where the platform is temporarily unavailable due to scheduled maintenance, upgrades, technical issues, or events beyond our control. We do not guarantee uninterrupted or error-free access at all times.
  • Short-term service interruptions (including those lasting 1–2 days) do not entitle you to a refund or compensation. In the event of extended or unplanned outages, we may, at our sole discretion, offer account credits or other remedies, but we are not obligated to do so unless explicitly agreed upon in writing.
  • You acknowledge and agree that Service Check Limited will not be liable for any direct or indirect loss resulting from service unavailability, including loss of business, revenue, or data.

5. Trial Period (if applicable)

  • We offer a one-month free trial to all new customers, including full access to the Service with unlimited job creation.
  • The free trial is limited to one per business and is intended for evaluation purposes only. No credit card is required to start the trial.
  • At the end of the trial period, users must activate a paid subscription to continue. If no subscription is activated, access will be suspended until payment is made.
  • We reserve the right to revoke or restrict trials in cases of misuse or suspicious activity.

6. Intellectual Property

6.1 Ownership

All intellectual property rights in and to the Service — including but not limited to the software, source code, user interface, design, trademarks, logos, text, graphics, databases, reports, documentation, and all other content — are and remain the exclusive property of Service Check Limited or its licensors. No rights or ownership are transferred to you through your use of the Service. You are granted only a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

6.2 Use Restrictions

  • You may not copy, modify, adapt, translate, or otherwise create derivative works of the Service or any part of it.
  • You may not disassemble, decompile, reverse engineer, or attempt to extract the source code or algorithms of the platform.
  • You may not remove or alter any copyright, trademark, or proprietary notices.
  • You may not use our brand name, logo, or visual elements in any way without prior written consent from Service Check Limited.

6.3 User Content

  • Any data, content, or materials you upload or enter into the system remain your property (“User Content”).
  • You grant Service Check Limited a non-exclusive, royalty-free license to use, store, and process your User Content solely to provide and improve the Service. We will not access, view, or share your data except as required to deliver technical support, as part of anonymized analytics or performance monitoring, if legally required, or with your explicit consent.

6.4 Feedback and Suggestions

  • If you provide us with any feedback, ideas, feature requests, or suggestions regarding the Service (“Feedback”), you agree that we may use that Feedback without restriction or obligation to you; you waive any rights you may have in the Feedback; and all Feedback becomes the property of Service Check Limited.

7. Customer Data

7.1 Ownership of Data

  • You retain full ownership of all Customer Data you enter into the Service, including but not limited to customer names, contact details, service records, job history, bookings, invoices, and related business information.
  • Vehicle information, while linked to your account, is stored in a centralised database and shared securely across all authorised mechanic shops using the Service Check platform to enable consistent service history and customer experience.
  • By using the Service, you consent to this sharing of vehicle information for operational purposes.
  • We do not claim ownership of your Customer Data but facilitate sharing of vehicle information as described above.

7.2 Our Access and Use of Data

By using the Service, you grant Service Check Limited a limited, non-exclusive, royalty-free license to store, access, process, and use your Customer Data for the purpose of providing and maintaining the Service; delivering technical support; improving system functionality and performance; and sending notifications and customer-facing updates on your behalf (e.g., job status, reminders). We will never sell, rent, or share your Customer Data with third parties for advertising or unrelated purposes.

7.3 Data Security

We take commercially reasonable steps to protect your data using industry-standard practices, including encrypted data transmission (HTTPS), access controls and authentication, and regular data backups and system monitoring. However, no system is 100% secure, and you acknowledge that there is always a risk of data breach or loss. Service Check Limited is not liable for any loss or unauthorized access to your data beyond our reasonable control.

7.4 Data Hosting

All Customer Data is stored on secure cloud infrastructure. We currently use AWS data centres and other services, which may be located in or outside of New Zealand, but are subject to strong privacy and security standards.

7.5 Data Retention Policy

  • We retain your Customer Data and service records for the duration of your active subscription to provide continuous access and support.
  • If your subscription is cancelled or inactive, we will retain your data for an additional 60 days to allow you to export your data or reactivate your account.
  • After this 60-day grace period, your data will be permanently deleted from our systems, except where retention is required by law.
  • We may retain anonymised or aggregated data indefinitely for analytics and service improvement purposes.
  • You may request data export or deletion at any time by contacting us.
  • It is your responsibility to ensure compliance with applicable data protection laws in your handling of Customer Data.

7.6 Responsibility and Compliance

  • You are solely responsible for the legality, accuracy, and ethical handling of any data you collect or input via the Service.
  • You must ensure your use of customer information complies with the New Zealand Privacy Act 2020 and any other applicable data protection laws.
  • You agree not to store any sensitive personal information (e.g., financial account numbers, government IDs, or health data) unless explicitly permitted.

7.7 Future Customer Portal

We plan to introduce a Customer Portal feature in the future, allowing your customers (vehicle owners) to securely log in and access their own service history, job updates, and related information. Use of this feature will be subject to additional terms and privacy safeguards, which will be communicated when the feature is launched.

7.8 Data Retention Options and Indefinite Storage

Currently, we retain data according to the policy above. In the future, we may offer options for longer-term or indefinite data storage subject to subscription plans and data management preferences. You will have tools and clear policies to manage your data retention preferences, including data deletion or archiving. You remain responsible for managing data privacy and compliance obligations, especially if enabling the future Customer Portal.

7.9 Data Sharing Across Participating Workshops

  • By using the Service, you acknowledge and consent that customer and vehicle data may be shared securely with other authorised workshops within the Service Check network.
  • This allows participating workshops to access previous service history and related information to provide better, more informed service.
  • Each mechanic/shop remains responsible for managing their own service records, while Service Check facilitates safe data custody and access.
  • We implement strict security measures to protect shared data and limit access to authorised users only.
  • Customers and workshops have rights under applicable data protection laws to access, correct, or request deletion of their data.
  • We may provide options to restrict or opt out of data sharing subject to legal requirements and platform capabilities.

8. Third-Party Services

8.1 Use of Third-Party Services

The Service may integrate with or rely on various third-party providers (“Third-Party Services”) to deliver key functionality. These may include, but are not limited to: Vehicle data providers, such as CarJam; SMS and communication gateways; Cloud hosting and infrastructure services, such as AWS, Auth0, etc; Payment processing and billing systems; Analytics, monitoring, and diagnostic tools. These integrations are managed by Service Check Limited as part of your use of the platform.

8.2 Your Responsibilities

  • Some features of the Service rely on third-party providers (e.g., CarJam for vehicle lookups, SMS gateways for customer notifications). These services are embedded in the platform and managed by Service Check Limited on your behalf.
  • You are not required to have direct agreements with these third-party providers. However, by using features that rely on them, you agree to comply with any applicable usage policies or limitations communicated by Service Check.
  • Service Check Limited is responsible for managing these integrations, including setup, maintenance, and monitoring.
  • We may impose reasonable usage limits, and where applicable, notify you of any additional charges for usage beyond standard plan allowances (e.g., SMS usage or excess vehicle lookups).
  • You agree to use these features for their intended purpose only and not to abuse or misuse integrated services in ways that could lead to excess charges or degradation of service quality.

8.3 Service Check Limited’s Role

  • We act as an intermediary for these integrations but do not control the performance, uptime, or availability of the Third-Party Services themselves.
  • We do not guarantee the accuracy, completeness, or reliability of data provided by third parties (e.g., vehicle data from CarJam).
  • We reserve the right to modify, replace, or suspend access to any integrated third-party feature at any time, with or without notice, to ensure platform stability or compliance.

8.4 Data Sharing with Third Parties

  • To enable specific features, Service Check Limited may securely transmit Customer Data to trusted third-party services (e.g., customer phone numbers for sending SMS messages).
  • We share only the minimum data necessary to perform the intended function and comply with data protection regulations.
  • These providers are subject to their own privacy and security policies, and we take reasonable steps to ensure they meet industry standards.

8.5 Consent to Third-Party Communications

  • By using communication-related features (e.g., SMS reminders), you authorise us to send messages on your behalf using third-party platforms.
  • While we strive to maintain reliability, we are not liable for delivery delays, failures, or disruptions caused by external providers.
  • You are responsible for reviewing and managing the content and frequency of any customer-facing messages sent through these channels.

9. Termination

9.1 Termination by You

  • You may cancel your subscription and terminate your use of the Service at any time by contacting us via email at support@servicecheck.co.nz or by phone.
  • Your subscription will remain active until the end of the current billing period, and no refunds will be issued for partial months or unused time.
  • After termination, access to your account and data will be disabled, and you will no longer be able to use the Service.

9.2 Termination by Service Check Limited

  • We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you breach any of these Terms or applicable laws; your account is overdue or unpaid beyond a reasonable period; you engage in abuse, misuse, or fraudulent activity on the platform; continued service is no longer commercially viable or technically feasible for us; or we are required to do so by law or regulatory authorities.
  • Where reasonable, we will provide notice and an opportunity to resolve the issue before termination.

9.3 Effect of Termination

  • Your access to the Service and all associated features will be revoked;
  • We will retain your Customer Data for a grace period of 60 days, during which you may contact us to export your data;
  • After this period, your data may be permanently deleted, unless otherwise required by law;
  • Any outstanding fees or charges will remain due and payable.

9.4 Survival of Terms

  • The following provisions will survive termination: Intellectual Property, Customer Data (to the extent required), Limitation of Liability, Dispute Resolution, and any other provisions which by their nature are intended to survive.

10. Disclaimer and Limitation of Liability

10.1 Disclaimer of Warranties

  • The Service is provided on an "as is" and "as available" basis.
  • Service Check Limited makes no warranties, express or implied, about the Service’s availability, reliability, accuracy, or fitness for a particular purpose.
  • We do not guarantee that: The Service will be error-free or uninterrupted; The information provided (including third-party data such as vehicle info) will always be accurate, complete, or up to date; Your use of the Service will result in increased business performance or outcomes. Use of the Service is at your own risk.

10.2 Limitation of Liability

  • To the maximum extent permitted by law: Service Check Limited and its directors, employees, agents, or affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages — including loss of data, loss of revenue, loss of business, or downtime — arising from or related to your use of (or inability to use) the Service.
  • If we are found liable for any reason, our total cumulative liability under this agreement shall not exceed the total amount you paid to us in the last 3 months preceding the claim.

10.3 Third-Party Services and Data

  • We are not liable for the accuracy, availability, or performance of any third-party services or data sources (e.g., CarJam) integrated into the platform.
  • You acknowledge that data provided by these services may be subject to change or limitations beyond our control.

10.4 Legal Protections

Nothing in this section limits any rights you may have under New Zealand law that cannot be lawfully excluded. If you are using the Service in a business capacity (which you are), the provisions of the Consumer Guarantees Act 1993 do not apply.

11. Modifications to Terms

11.1 Right to Modify

Service Check Limited reserves the right to modify, update, or replace these Terms & Conditions at any time, in whole or in part, at our sole discretion. Changes may reflect updates to our services, pricing, features, legal obligations, or business policies.

11.2 Notification of Changes

When changes are made, we will notify users by posting the updated Terms on our website or platform; and/or sending email or in-app notifications if the changes are material. The date of the latest revision will always be indicated at the top of the Terms.

11.3 Acceptance of Changes

By continuing to access or use the Service after changes are posted, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

12.1 Good Faith Resolution

In the event of any dispute, claim, or disagreement arising out of or relating to these Terms or the use of the Service, both parties agree to first attempt to resolve the matter in good faith through direct communication. You may contact us at support@servicecheck.co.nz to initiate a resolution process.

12.3 Legal Action and Governing Law

If the matter cannot be resolved through good faith discussions or mediation, either party may pursue legal remedies. These Terms are governed by the laws of New Zealand, and both parties submit to the exclusive jurisdiction of the courts of New Zealand.
