Customer Terms of Service

1. Agreement to Terms

By accessing or using ServiceCheck ("Platform"), you agree to be bound by these Customer Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

ServiceCheck is a platform that connects vehicle owners ("Customers") with registered automotive service providers ("Mechanics" or "Service Providers"). ServiceCheck acts as an intermediary and does not provide automotive services directly.

2. Eligibility

You must be at least 18 years old to use ServiceCheck. By using the Platform, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • All information you provide is accurate and current
  • You will maintain the accuracy of your account information

3. Account Registration

You can book services as a guest without creating an account. However, creating an account is recommended to:

  • View and manage your bookings in one place
  • Access your full service and payment history
  • Receive reminders for WOF, registration, and service due dates
  • Leave reviews and rate service providers

If you choose to create an account, you agree to:

  • Provide accurate, complete registration information
  • Maintain and update your information to keep it current
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized account access
  • Accept responsibility for all activities under your account

4. Platform Services

ServiceCheck provides the following services to Customers:

  • Mechanic Directory: Browse and search registered automotive service providers
  • Online Booking: Schedule appointments with service providers
  • Service Tracking: Real-time updates on service progress
  • Vehicle History: Digital record of your vehicle's maintenance history
  • Reminders: Automated notifications for WOF, registration, and service due dates
  • Reviews: Ability to rate and review service providers

5. Bookings & Appointments

5.1 Booking Process

When you book a service through ServiceCheck, you are entering into a direct agreement with the Service Provider. ServiceCheck facilitates the booking but is not a party to the service contract.

5.2 Booking Confirmation

Your booking is confirmed once the Service Provider accepts your appointment request. You will receive confirmation via email and/or SMS.

5.3 Cancellations

ServiceCheck does not manage or process cancellations. Cancellation policies are set and managed by individual Service Providers (mechanics). Please check directly with your chosen mechanic regarding their cancellation policy, fees, and procedures before booking.

6. Payments & Refunds

ServiceCheck does not process or handle any payments between customers and mechanics. All payments for services are made directly between you (the customer) and the Service Provider (mechanic), using the payment methods accepted by the Service Provider. ServiceCheck does not collect, hold, or refund any customer payments.

Any questions or disputes regarding payments, refunds, or billing must be addressed directly with the Service Provider. ServiceCheck is not responsible for payment processing, refund decisions, or the handling of funds.

For more information, please refer to the Service Provider's own payment and refund policies. ServiceCheck does not provide a refund policy, as we do not process or handle any payments.

7. Platform Usage & Prohibited Conduct

You agree NOT to:

  • Use the Platform for any illegal purpose
  • Provide false or misleading information
  • Impersonate any person or entity
  • Harass, abuse, or harm Service Providers or other users
  • Post fake, defamatory, or fraudulent reviews
  • Attempt to bypass the Platform to book services directly (for first booking)
  • Scrape, copy, or download Platform content without permission
  • Interfere with the Platform's operation or security

8. Reviews & Ratings

You may leave reviews for Service Providers after completing a service. By submitting a review, you grant ServiceCheck a perpetual, royalty-free license to use, display, and distribute your review. Reviews must:

  • Be based on genuine personal experience
  • Be honest and factually accurate
  • Not contain offensive, defamatory, or discriminatory content
  • Not violate any laws or third-party rights

We reserve the right to remove reviews that violate these guidelines.

9. Liability & Disclaimers

9.1 Platform Role

Important: ServiceCheck is a marketplace platform that connects customers with independent Service Providers. We do NOT:

  • Provide automotive services directly
  • Employ or control Service Providers
  • Guarantee the quality, safety, or legality of services
  • Warrant that Service Providers are qualified or licensed

9.2 Service Provider Responsibility

Service Providers are solely responsible for the quality and safety of their work. Any disputes regarding service quality, damage, or injury must be resolved directly with the Service Provider.

9.3 Limitation of Liability

To the maximum extent permitted by New Zealand law, ServiceCheck shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or services booked through the Platform.

10. Intellectual Property

All content on the ServiceCheck Platform, including logos, text, graphics, and software, is the property of ServiceCheck or its licensors and protected by New Zealand and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

11. Privacy & Data Protection

Your use of ServiceCheck is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with the New Zealand Privacy Act 2020.

12. Account Termination

You may close your account at any time by contacting support. We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Repeatedly cancel bookings or fail to show up
  • Abuse Service Providers or staff

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved through:

  1. Good faith negotiation
  2. Mediation (if negotiation fails)
  3. New Zealand courts (if mediation fails)

15. Consumer Guarantees Act 1993

Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993. If services are not provided with reasonable care and skill, you may have rights under this Act.
